1. Introduction

These Terms and Conditions govern your use of the NurseFlex platform (nurseflex.co.uk), operated by Flexero Ltd, a company registered in England and Wales. By accessing or using NurseFlex, you agree to be bound by these Terms.

3. Account Registration

You must provide accurate, complete, and current information during registration. You are responsible for maintaining the confidentiality of your login credentials and for all activities under your account. NurseFlex reserves the right to suspend or terminate accounts that contain inaccurate or fraudulent information.

4. Professional Requirements

Healthcare professionals using NurseFlex must hold valid registration with the relevant regulatory body (NMC, HCPC, GPhC, or equivalent). Professionals must maintain up-to-date compliance documents including DBS checks, right-to-work documentation, mandatory training certificates, and professional indemnity insurance where required.

5. Organisation Obligations

Organisations must comply with CQC regulations, employment law, and NHS framework requirements where applicable. Organisations are responsible for verifying that booked professionals meet their specific site requirements. Payment terms for completed shifts must be honoured within the agreed timeframes.

6. Shift Bookings & Cancellations

Once a shift is confirmed through NurseFlex, both parties are expected to honour the commitment. Cancellation policies apply as follows: cancellations more than 48 hours before the shift start time incur no penalty; cancellations within 24-48 hours may incur a fee of up to 25% of the shift value; cancellations within 24 hours may incur a fee of up to 50% of the shift value. No-shows may result in account suspension.

7. Payments

Professionals are paid for completed and approved shifts according to the rates displayed at the time of booking. NurseFlex processes payments weekly via BACS transfer. Organisations are invoiced according to their agreed billing cycle. NurseFlex charges a platform fee as outlined in the applicable pricing plan.

8. Compliance & Data

NurseFlex stores compliance documents securely in accordance with NHS Digital standards and GDPR. Documents are verified through automated and manual checks. Expired documents will trigger alerts and may restrict the professional's ability to book shifts until updated.

9. Intellectual Property

All content, design, logos, and software on the NurseFlex platform are the property of Flexero Ltd and are protected by intellectual property laws. Users may not copy, modify, distribute, or reverse-engineer any part of the platform without written permission.

10. Limitation of Liability

NurseFlex acts as a technology platform connecting healthcare professionals with organisations. We do not employ the professionals listed on our platform. To the maximum extent permitted by law, Flexero Ltd shall not be liable for any indirect, incidental, or consequential damages arising from use of the platform.

11. Termination

Either party may terminate their account at any time. NurseFlex reserves the right to suspend or terminate accounts that violate these Terms, engage in fraudulent activity, or pose a risk to patient safety. Outstanding payments remain due upon termination.

12. Changes to Terms

Flexero Ltd may update these Terms at any time. Users will be notified of material changes via email and platform notification. Continued use of the platform after changes constitutes acceptance of the updated Terms.

13. Governing Law

These Terms are governed by the laws of England and Wales. Any disputes shall be subject to the exclusive jurisdiction of the English courts.
